Terms of Use 
How are my designs delivered?

Your designs will be delivered by instant download right away after purchase and also you will receive an email with a link to be able to download the design.  You will be able to download these as many times as you would like.  You must keep your email to do this..   I DO NOT RECOMMEND PURCHASING OR DOWNLOADING THESE TO YOUR CELL PHONE TO TRANSFER TO YOUR COMPUTER.   i ALSO DO NOT RECOMMEND BRINGING MY DESIGNS INTO ANY OTHER SOFTWARE YOU MAY HAVE.  (I have spent a pretty penny to have the best software I possible could to digitize with for the best possible designs) They are meant to go from your computer to your embroidery machine only.  I cannot help you once I know you are using my designs with other software.  

What are your terms of use?

Designs can be used on items to be sold as long as long as you do not mass produce. Designs (either purchased or free) cannot be sold, traded, shared or included in another design package, including copying with the intent or sharing with friends or family.

Wingsical Whims Embroidery Designs Credit Terms

If you are a home crafter and stitch the designs yourself for sale (ie on eBay, through a website, at markets, or in craft shops), I do not consider this mass producing if you are stitching out the design less than 100 times or your Business makes less than $500 a year.  You must give Wingsical Whims Embroidery Designs Credit.   I fully encourage the use for these purposes.  If you are producing more than 100 times or your Business makes over $500.00 a year I encourage you to get a Commercial License for Wingsical Whims Designs or if you choose not to give me credit for the Designs of Wingsical Whims Embroidery You will need to get a  Commercial License from us.   

Custom Digitizing

Custom Digitizing:  When asking for Custom Digitizing for one of your clients, you will need to purchase the Commercial License.  It is a one time purchase and you can use it for the life of your Business.  It is non-transferable.   This also gives your Customer and YOU the rights to use the Custom Digitizing as much as you would like.  You can however, choose not to give the Embroidery Format to your Customer.   That is up to you.  I will not Transfer the Custom Design to anyone else but you. 
If you are working with a client that is a Non Profit, I will need to see their Tax Exempt Certificate. 
​You will NOT have to pay for this Commercial License for that individual Custom Design.   
 

Please note that copying embroidery designs or sharing them is a copyright violation and consequently is illegal. This is irrespective of whether you purchase the design or download a sample. You merely have a license to use the software/download in accordance with my terms. However, you are allowed to make one copy for back-up purposes. You are also allowed to customize designs for your personal use, but you must not offer customized embroidery design files for resale (only on hand finished products) or claim it as your own
All Sales are final.  There are no returns on Digital Downloads or any I want it all Packages.
You will have to enter all your information in each time, this includes  Name, Address Phone Numbers and Credit Card Numbers when you purchase.  I do not save Credit Card information nor does my web host.  This way there is no question on what you have purchased for Digital Downloads and this is my way of protecting myself from Fraud.   This also helps you knowing that you have to enter this each time for your protection.

With the many different Computers, Phones,  and Operating Systems out there as well as the many different Embroidery Software out there I cannot help or offer help in those areas.
I also do not recommend adding my designs to any other software for transfer or to alter to fit your hoop/machine.  I have digitized these to go from computer directly to machine. or USB to Machine  And have tested each and everyone of these myself with a Great Stitch Out.    
I do not recommend using a phone for downloading.  But using your computer directly.

Freebies

Our freebies are offered as a courtesy to try before you buy.  We have several in the Freebies section and through out the site.  If once a Freebie Design and Now a paid design, I cannot send you the design that is no longer free.  I am spending a lot of time re sending free designs.  As of 11/01/2015 I will no longer send free designs out after the fact.  Make sure you have downloaded correctly through the direct download or email before you leave the site. 

It is NOT my responsibility if you are having computer issues with the FREEBIES.   These are a gift from me to you, please don't make me feel bad about you missing one or are having technical difficulties with your equipment.   Thank you!

What is your refund policy?

 Due to the nature of embroidery software and digital designs, we do not offer refunds or exchanges.  All designs have been tested and stitched a number of times prior to being offered for sale.  
All Sales are Final.  I am sorry it is not my responsibility if you have already purchased designs.  I do not allow refunds or exchanges.
